Terms of Sale and Use

These terms govern use of meshnest.co.za and purchases from Mesh Nest. By browsing, creating an account or placing an order you agree to them. If you do not agree, do not use the site.

1. Who we are

The site is an online shop for home-automation products and may also be used to request quotes or installation.

2. Eligibility and accounts

You must be 18 or older and able to enter a binding contract. Keep your login details confidential. You are responsible for activity on your account. We may suspend or close an account if we reasonably suspect misuse or fraud.

3. Products, prices and quotes

Product descriptions, images and specifications are provided in good faith. Features depend on your home wiring, network, power supply and compatible hubs. We do not guarantee that a device will work with every third-party platform.

Prices are in South African Rand and include VAT unless stated otherwise. We may correct obvious pricing errors and cancel an affected order with a full refund.

A quote is an invitation to treat, valid for the period shown on the quote (or 14 days if none is shown), and is not an order until we confirm it in writing.

4. Orders

An order is an offer. A contract is formed when we send an order confirmation by email. We may refuse or cancel an order (for example stock, payment failure, suspected fraud, or delivery area). If we cancel after payment, we refund the amount paid for that order.

5. Payment

Payment is due at checkout unless we have agreed otherwise in writing (for example a deposit on a quote). Title in goods passes when we receive cleared funds. Risk passes on delivery to you or your nominated recipient.

6. Delivery and collection

Delivery estimates are not guarantees. Delays caused by the courier, incorrect address, load shedding affecting depots, or events outside our control are not a breach by us, though we will help track the parcel.

If you choose collection, we will notify you when the order is ready. Uncollected goods may be treated as unclaimed after a reasonable period and we may charge storage or cancel and refund less reasonable costs.

You must inspect goods on receipt and report shortages or transit damage within 48 hours of delivery, with photos where possible.

7. Installation and compatibility

Unless an order expressly includes installation by Mesh Nest or a nominated installer, you are responsible for safe installation, wiring and configuration. Incorrect installation can damage products or your property and may void the manufacturer warranty.

Smart devices may require a stable internet connection, a compatible hub, and correct electrical supply (including neutral wires where required). We are not liable for incompatibility that was reasonably disclosed or is inherent to the product.

8. Consumer rights

Nothing in these terms limits your rights under the Consumer Protection Act 68 of 2008 or other mandatory law. Defective, unsafe or not-as-described goods may be repaired, replaced or refunded as the CPA requires.

If you concluded this agreement electronically as a consumer, you may have a cooling-off right under section 44 of the Electronic Communications and Transactions Act 25 of 2002 (generally seven days after receiving the goods), subject to the exclusions in that Act (including goods that have been unsealed, customised, or that cannot be returned for health or hygiene reasons).

9. Acceptable use

You may not misuse the site, attempt to access other users’ accounts, scrape content, or upload unlawful material. Product images, logos and copy on this site belong to Mesh Nest or their licensors.

10. Liability

To the extent permitted by law we are not liable for indirect or consequential loss, loss of data, or loss arising from your installation, configuration, or use of third-party software or services. Our total liability for any order is limited to the amount you paid for that order, except where the CPA or other law does not allow a limitation (including death, personal injury, or gross negligence).

11. Changes

We may change these terms. The updated version applies to new orders after the “Last updated” date. Existing confirmed orders remain on the terms in force when we accepted them.

12. Law

These terms are governed by the laws of the Republic of South Africa. Courts of Johannesburg have non-exclusive jurisdiction, without limiting any statutory forum a consumer may use.
